temperatures in the 80s in the east bay by noon. in the 90s by 4:00. 78 degrees in san francisco and 85 in redwood city. if you like the heat, you like the forecast i have coming up. >> if it looks like the state may finally have a budget deal. scholarship money and senior services and all state offices like the dmv, parks and roads are tied up because of the process. christie smith is live in oakland with more on when we might see a breakthrough. christie? >> reporter: good morning. the governor spokesman said lawmakers will work through the weekend in sacramento and hope to have a deal hammered out as early as monday. the state has been able to pay most of the bills while this is going on. state law prevents some checks from going out without a budge net place. some groups have not been paid since july. that includes health clinics and the poor and college students on

financial aid and development programs. for people tied to this, it is great news. at least the check is closer to being in the mail. a glimmer of hope for the state to finally solve the $19 billion budget deficit and the framework includes 7.5 billion in cuts. where the cuts will fall is still unclear. it also relies on boosting the bottom line with federal dollars that aren't quite promised to the state. the state has now been without a budget for 86 days and that's the longest delay in state history. reporting live in oakland, christie smith, today in the bay. the fate of the military's controversial don't ask don't tell policy in the hands of a federal judge. lawyers are trying to stop a court in san diego from issuing an injunction that would stop the military's ban on openly gay

troops. the white house said they are defending an act of congress being challenged and it doesn't detract from the effort to get the act repealed as well. a federal judge will decide whether all ex-cougs in california can resume. if the judge rules in favor, convicted murderer albert greenwood brown will be the first in line. he was found guilty of abducting, raping and killing a 15-year-old girl in 1980. he is scheduled to die on wednesday at 12:01 a.m. he would be the first to be executed in california in almost years. executions have been halted since 2006 because another inmate claimed the process was cruel. the procedures have been updated. virginia completed a rare execution for the first time in five years. a woman was put to death. teresa lewis died by lethal injection after a ranging the murders of her husband and stepson to collect an insurance pay out.

lewis was the first woman executed in virginia in nearly a century. court proceedings could come to a stop for the rapist accused of kidnapping jaycee dugard. garrido will number court this afternoon. the sacramento bee said his lawyer could argue he is not capable of standing trial. he and his wife are accused of holding jaycee dugard captive in the back of their home for 18 years. they have been held in the placerville jail for more than a year now. a community will mourn the loss of a family killed in their home in the san bruno pipeline explosion. greg and his motherula von and son william were killed when the flame ripped through the home two weeks ago. the memorial will start at the first presbyterian church of burlingame.

touch with other drugs that may be more harmful. marijuana has been called a gateway drug and it's called that because when you go to illegal channels to procure it, you will run into other substances. >> do you think there is a double standard in particular in california because there is a massive opposition to big tobacco and smoke, but they turn around and it seems like there is support for legalizing marijuana? is there a double standard? >> i don't think so. tobacco has been proven to be extremely harmful and marijuana has been proven to be a powerful, useful drug. >> some people say the carcinogens in marijuana is high and smoking is just not healthy. >> we are forms of other forms of ingestion. edible forms and vaporizing that heats it to the point where it releases the good stuff and doesn't combust. we are big proponents of

vaporizing. >> getting back to the expo that you can learn about. >> correct. >> i know you have been with us all morning. we appreciate your time this morning. >> thank you. >> cal grad sarah shourd holding out hope she will mead with the iranian president in new york. her fiance shane bauer and their friend, josh fattal remain in jail on spying charges. shourd explains what happened and what life is like inside the prison. >> soldiers approached you? >> yeah. before i knew it, i was torn apart from shane and josh and thrown into a cell and that's where i have been for the last 14 months. the important thing to remember is that's where shane and josh still are. they are in the same size cell i was in, crammed in for no reason. something committed no crime and they don't know when they will get out. they have to exercise on the space the size of a towel.

there is little sun light and very little time out of the cell and no communication with their family. you can see the whole interview at 7:14. the iranian president is in new york to address the united nations. he shocked world leaders and sparked a walk out when he said the u.s. government planned and staged the september 11th terror attacks. the iranian president is stirring up controversy. deja vu news. news you think you heard before because you have. he said most people think the u.s. government staged the attack to assure israel's survival. the comments caused the allegation to walk out of the speech and all 27 european nations followed them as well as representatives from australia, new we will have ant, canada and costa rica. a bay area business that most of us use every day are in the headlines.

not only did he try to rape the jogger on sunday, but they think he's the same man who raped a woman in morgan hill last year. they have the flyers posted where the jogger was attacked on sunday. she fought him off by kicking and screaming. it's shobing to hear about that kind of an attack. >> surprising. >> up here, yeah. it's a gentle neighborhood so i'm surprised, but a lot of crazies running around. >> i don't want someone like that to make me be afraid and ruin my way of my life every day. >> police say if you do jog, make sure you partner up with somebody and carry a whistle or pepper spray. won't carry a weapon because that makes a bad situation even worse if the attackerens uptakeing it from you. >> a bay area man is guilty of killing an officer with special

circumstances. the officer parked his cruiser in the middle of the road to stop the man leading officers on a high speed chase in 2006. they slammed the van into the cruiser, killing the 39-year-old officer. his father said he forgives patrely. >> mr. patrely, we forgive you. we are just human. we make mistakes. to your family, we bear no grudge. >> the jury found him guilty of 10 counts. he could be sentenced to in prison without the possibility of parole. he is scheduled to be back in court in october. >> thousands of volunteers are expected to hit california beaches tomorrow for coastal clean up day. the california coastal commission is behind that day and said last year more than 80,000 volunteers picked up 1.3 million pounds of trash and you can still get in and help out this year.

could get triple-digits by the weekend in some places. time is running out and your kids may not get a school lunch if nothing is done by next friday. funding for the school lunch program will run out. tracie potts is live in washington with what lawmakers are doing and how they can make lunch healthier in the process. >> good morning, everyone. something will be done before next friday. the senate passed authorize aation to reauthorize the programs. the house is planning to vote on it sometime today. here's the challenge. how to pay for it. it's a $4.5 billion program to authorize lunch and breakfast and most of that money is to reimburse local schools like those in your area for the money spent to make the lunches healingier to put in fruits and vegetables. they have not had a raise in nearly 30 years. they may get a six-cent raise

per meal. it's not enough, but what congress is considering. to pay for that, what the obama administration and propone epts top the do is roll back the benefits they approved last year as part of the stimulus bill. that program would end early in 2013. the extra money would be put towards this. there a lot of people here who have concerns about that, including nearly 100 democrats, unions, teachers, the congressional back caucus not happy about that. what there is a consensus on is this. new standards for schools to get any of that money, schools would have to agree to get the junk food out of not only lunches and breakfast, but vending machines and other events. many districts and states have already done this. this would be a new federal standard for every school in the country. live in washington, i'm tracie

blip through pittsburgh, earlier than it happens. it might be traffic adjusting. the flow increasing and the metering lights were turned on and we last saw them about 10 minutes ago. now folks have been all the way to the end of the parking lot and no room for the people coming in off the east shore freeway. all the guys westbound with the headlights past university avenue. a live shot out there on university avenue. folks traveling under the freeway with the headlights through berkeley and emeryville. that will add to the congestion and heading eastbound out of the area. get away traffic will be an issue. it's warm. >> because you want to stay cool getting away to the mountains or the beach. nice temperatures this morning and it feels good outside. by the time we get to the lunch hour, temperatures in the 80s. we are looking at forecast highs in the 90s. with a few areas reaching 100
